What is a Bill of Lading?

A Bill of Lading is the most important shipping document in sea transport.

It acts as:

  1. Contract of carriage between shipper and shipping line
  2. Receipt of goods shipped
  3. Document of title (ownership of goods)

All terms, conditions, and liabilities are printed on the back of the BL.

Responsibilities of the Shipper

Must understand:

  • Their liability
  • Trading terms (Incoterms) agreed with the buyer
  • Who will pay freight and other charges
  • Must ship goods as per agreed terms
  • Must surrender the Bill of Lading to the shipping line on an agreed basis

 

  • In Letter of Credit (LC) shipments:
  1. Shipper collects all original BL sets (usually 3 originals)
  2. Couriers originals to the consignee/bank for payment and customs clearance

Role of the Original Bill of Lading

Whoever holds the original BL is the owner of the goods

  • Shipping line’s liability ends after issuance of the original BL

 

  • Shipper remains the owner until:
  1. Payment is received from the buyer
  2. Original BL is handed over to the consignee
  • Consignee submits original BL to:
  1. Bank
  2. Customs

                       iii. Shipping line for delivery order and cargo release

Telex Release

Used when buyer has paid fully to shipper

  • Procedure:
  1. Shipper surrenders original BL to issuing authority/shipping line
  2. Shipping line sends telex/email release to destination agent
  • Advantage:
  1. No need to send physical original BL
  2. Faster cargo release
  • Once BL is surrendered:
  1. Shipping line’s liability ends

Lost or Misplaced Bill of Lading

If BL is lost:

  1. Police complaint is mandatory
  2. Newspaper advertisement in two separate newspapers
  3. Written request to shipping line
  4. Indemnity & declaration by parties
  5. NOC from consignee and bank (if involved)
  6. Shipping line may issue a duplicate BL
